Summary

Attorney Fenstermaker boasts more than a decade of medical malpractice and professional liability litigation experience, including successfully defending a number of healthcare providers as lead counsel at trial and binding arbitration. He has experience defending hospitals, physicians and other healthcare providers in complex medical malpractice matters, often involving catastrophic injury or death. Attorney Fenstermaker has also successfully briefed and argued complex legal issues of first impression in front of Pennsylvania appellate courts, including the Supreme Court of Pennsylvania.

Attorney Fenstermaker is the firm's managing partner; he is the attorney who oversees the day-to-day operations, strategic direction, and overall management of the firm, essentially acting as the "CEO" of the partnership, responsible for financial health, business development, and ensuring the firm runs smoothly and profitably

While his practice has been focused on representing healthcare providers, Attorney Fenstermaker has also successfully represented a broad spectrum of other licensed professionals in malpractice litigation, including engineers, architects, lawyers, among others. Attorney Fenstermaker was recognized by Lehigh Valley Business Magazine in 2023's Forty Under 40 Awards. This award recognizes young professional leaders in Berks, Bucks, Carbon, Lehigh, Monroe, Montgomery, Northampton, Schuylkill and Warren Counties, for success in their careers and giving back in meaningful ways to the Lehigh Valley community.

About Adam

Adam is a Lehigh Valley native, having been born and raised in Bethlehem, Pennsylvania. Following law school in Philadelphia, he practiced law in Denver, Colorado defending doctors and other licensed professionals, before returning to Pennsylvania and starting his own firm doing the same.

Mr. Fenstermaker has a wealth of trial experience, having taken more than 25 medical malpractice cases to verdict at trial or binding arbitration.

In his free time, Attorney Fenstermaker enjoys coaching youth basketball, and traveling and spending time with his wife, Jasmine.

Verdicts

Mr. Fenstermaker has achieved many notable defense verdicts at trial and arbitration in his litigation career, including:

A 2024 defense verdict for a small community hospital following an 8 day jury trial in Luzerne County, Pennsylvania. The defendant hospital allegedly failed to appropriately diagnose and treat a 9 year old boy's torsed testicle, resulting in the loss of the organ.
A 2024 defense verdict following a 5 day jury trial in which he represented two gastroenterologists who allegedly failed to appropriately plan for and perform a colonoscopy, during which the patient tragically died.
A 2024 defense verdict following a 6 day jury trial in Lehigh County for a gastroenterology practice that allegedly failed to manage a 40 year old patient's liver disease, which resulted in an upper GI bleed and catastrophic brain injury. The plaintiff introduced nearly $8 million dollars in economic damages in evidence. The jury rendered a verdict for the GI practice, with a finding of no negligence.
A 2023 defense verdict following a week-long jury trial in Lackawanna County, for a gastroenterologist that allegedly failed to appreciate findings suspicious for colorectal cancer on three separate colonoscopies, resulting in a delay in diagnosis such that the cancer became untreatable.
A 2022 defense verdict for a long-term care facility that allegedly failed to timely diagnose a patient’s necrotizing fasciitis, resulting in prolonged pain and suffering, and ultimately, death.
In 2022, the dismissal of 25 separate, distinct medical malpractice lawsuits against an orthopedic surgeon who allegedly failed to properly perform knee replacement surgeries on 25 different patients.
A 2022 defense verdict for an emergency medicine physician who allegedly failed to timely diagnose a thoracic aortic dissection and failed to timely transfer the patient to hospital capable of the necessary surgical intervention, resulting in the patient's death.
A 2021 defense verdict for a podiatrist who allegedly was negligent during the performance of a plantar wart excision surgery, causing the minor-Plaintiff to develop CRPS/RSD.
A 2019 defense verdict for a podiatrist who alleged failed to timely treat osteomyelitis in the toe, resulting in amputation.

Q&A

What professional skills do you find most important to be successful?

Hard work -- there is no substitute for it. You can work hard and have varying degrees of success; but you cannot be successful without first working hard. Everyone needs a bit good fortune and opportunity, but the foundation for capitalizing on those opportunities is good, old fashioned hard work.

What’s your favorite part of your job?

I take great pride in defending healthcare providers in malpractice litigation. These doctors, nurses and other providers have devoted their lives to the noble task of helping sick people get better. I have seen firsthand the emotional toll that a malpractice lawsuit has on so many of my clients. It is extremely rewarding to be given the privilege of helping them through a difficult situtation, in the same way that they help their patients.

If you had to choose a different career, what would it be?

If I was not a lawyer, I would like to be a high school basketball coach. I have a great passion for teaching, a love for the sport of basketball, and a fervor for competition. I hope to have the opportunity to coach basketball at a high level in the future when my schedule permits.
