Congratulations to John Hill and Tara Weitz for successfully achieving the dismissal of a medical malpractice claim against their client, a Psychiatrist. Plaintiff had alleged that the Psychiatrist, along with the facility in which their client worked, was negligent in prescribing an excessive amount of psychiatric medication to Plaintiff, which allegedly resulted in Plaintiff collapsing on her infant (Plaintiff’s decedent), which, in turn, caused the infant’s death by way of positional asphyxia. Throughout the litigation, there were numerous discovery disputes which weighed on the outcome of this litigation. Ultimately, Attorney Hill and Attorney Weitz were able to have the case dismissed against the Psychiatrist on the eve of trial without any contribution or settlement on behalf of their client.
